    Default Do I Have a Right to View My Credit Card Receipts

    My question involves employment and labor law for the state of: New York (not the city)

    I have been waiting tables for some extra cash and the owner refuses/is very annoyed when I ask to view the receipts from credit card slips (many people walk up to the register to pay so I often am unable to see how much they tipped). Do I have a right to view the credit card slips that show the amount the customer tipped? The tips are paid in cash at the end of each shift.

    No, you don't. They are a transaction between the house and the customer which you have no legal right to demand to review. While your point is understood, it does not provide you a right to review the slips. If you believe you are being shorted, there are means to demand a review although that will get very messy very quickly.

    If you're going to work as a tipped employee, it would behoove you to read the IRS guidance (http://www.irs.gov/publications/p531/ar02.html) on such. If your employer is not going to provide you a tip record (and he is under no obligation to do so), it is incumbent on you to keep track of what you were tipped.

    I have been shorted, although it was claimed "accidental." On several busy night that I managed to record all my credit card tips for the night, I requested to see the credit card slips because the total my boss gave me was not the same as I added up, and in both cases he found that he had "accidentally" put the tip under his number not mine.

    If I don't have a right to view the actual credit card slips, can I request to know the individual amounts of the credit card tips, so that I can check them against my records?

    I'm not saying I will, I just want to know my rights. I make decent money at this job even with the owner making "mistakes".

    no, you do not have a right to see anything the boss doesn't want to show you. The state may though, if there is a valid justification for them to demand such information.

    jk, in most restaurants, sales are rung under an employee number. So, say you're cashiering. Jenny has a $40 sale and an $8 tip on that, credit card sale. Jessie has a $37 sale, cash. Eliza has a $43 sale, $8 tip on that, gift certificate. Each sale is rung in with each server's employee ID, carryout orders are rung under the cashier's ID.

    Our OP is saying, essentially, that her boss has been cashiering, and ringing her sales out under his ID number. On credit card and gift certificate sales, that would credit the tip to him.

    Discrepancies SHOULD be picked up when any given ID is closed out for the night - the cashier should show zero tips on his/her report - and any restaurant worth a damn should be having servers look at their reports each night and SIGN THEM once everything is settled out. It's way less messy than having the state come in and demand to know why non-tipped employees are getting tips.
