    Default Responsibility of Debt After a Divroce

    My question involves a marriage in the state of: California

    My ironically enough has a bit of a gambling problem. So to not have his money borrowing affect my mom, they have decided to get a divorce after the house gets put in her name. I have a couple of questions for this one. One, if he already is in debt, is that portion already partially her responsibility? Second, if they do get divorced and he continues to live with her, would it be possible for his future money borrowing to also affect her?

    In California, yes, since they are a community property state when it comes to marriages.

    Transferring the property now is likely to not provide the benefits she wishes to create, again, due to it being a community property state.

    They should really speak directly with a lawyer concerning this. There is no sense spending money that will not benefit them.
