If it's not sexual, or related to another characteristic protected by law, then there is no SOL because you can't sue in the first place.
If this is related to your previous post, if the employee really wants to make an idiot of himself he can try to sue for 300 days after the incident occurred. But since what happened is not illegal harassment and he has no grounds to sue, it's a moot point.

NO. The dumb "is this like a disease or aids, what can we do to help comment" IS NOT HARASSMENT AND THE EMPLOYEE HAS NO GROUNDS TO SUE.
