Angry Accused of Helping a Friend Shoplift

i was with a friend shopping at well known store - this friends decides she's going to take somethings in shopping cart - couldn't believe that. I got scared and took what I came to the store to get - and went to register paid and proceeded to leave - the LP apparently were watching and stopped us before she could get out of the store - the accused me of looking out while she did what she did and one also accused me of putting some things in bags. police came - and we were arrested and charged with felony theft. I feel like I'm in a night mare - I have no prior record - not even a traffic violation, but apparently she does - don't know all the details. I was booked and let go - she was kept in. What usually would happen in this case. I asked LP to show me on tape were they saw me do this - but they did not and insisted that I did it. I obtained a lawyer the next morning - I am so upset and have been stressed since the incident happened - I feel it's unfair and am nervous that LP will definately be believed over me. I have no reason to shop-lift let alone felony shoplift. They found nothing on me (in my purse) but things in hers:

Get a lawyer to help you figure this out, or at least, go to a free consultation!

Your lawyer should be able to obtain the videos either from the store (a subpoena would probably be necessary) or, depending on the practice in your jurisdiction, through the police or prosecutor's office.

Make sure you keep your receipt. that way it shows the judge that you came to buy not shoplift. also take this advice......whenever you have a freind who begans to shoplift in your presence tell her to put it back immediately or you will tell the store manager yourself. why do this? because you are a real freind and you don't want to help her loose her freedom and your's. by you making a stand like this. she will hate you at first but after she calms down and see reason. she will have a newfound respect for you If she refuses tio listen you got 2 choices tell the store manager or completetly leave the store, just leave her where she is standing. you can always return to the store and shop at a later date without her.

But you are to blame.....you witness a crime taking place and chose to let your emotions get involved instead of doing the right thing. you thought as long as i am not doing it. i am o.k. WRONG!!! look at what happend too you now. you got arrested and blamed for the crime too.

I think in my opinion you will get off easy. because you did'nt take anything. and you have your receipt. and they don't have you on video because you did'nt steal. also you have a clean record says a lot about you. your freind is not a freind and if she was. she should be telling the prosecutor that you had nothing to do with what she carried out in that store. You did the right thing by getting a lawyer. i can see you getting out of this o.k. in my opinion you should walk scott free without any probation and i hope the lawyer see too it that they get that arrest off your record immediately. They took both of you because it made them looked more macho to get 2 instead of one. sometimes store security is like that too proud
