My question involves employment and labor law for the state of: texas
I have two issues that I'm wondering what my rights are. I'm a mechanic with a ton of experience in both the repair side and management side of the shop. I was struggling to make ends meet and after putting in several applications I got an offer out of Texas. The employer said he was desperate for help and could easily provide me with 30-40 flag hours a week. That sounded great, so I used every last dime my wife and I had to move to Texas. When I arrive he had about 5 flag hours for me the first week, then nothing. That's less than minimum wage.
I am the only tech there that knows what I'm doing so he decides to 'promote' me to service manager but still allow me to pull in flag hours. So he tells me 16.00 per hour for management duty. I thought great! That's fine.
2 days later he pulls me into his office to tell me be can only pay me for 3 hours a day at 16.00. The rest must come from flag hours (which there were 2 this week). That would've been fine if I could leave after my 3 hours to find additional emoyment, but he insists on me being there all day 45+ hours a week.
My wife and I are on the verge of losing everything now. My question being is my employer within the law by what he's done? Are flag pay workers entitled to at least minimum wage?
