    Default Effect of Being Rehired Part Time on Unemployment

    My husband is getting unemployment (about $1000) a month and now his former employer wants to hire him for part time work. They want to hire him through a temp. agency of which the agency wants him to fill out i9/w4 forms. The temp. agency also said that they do not get jobs from his field of work and the work he receives from his former employee will be the only work that he will get through their agency. We are really not sure how much work they are going to give him, but somewhere between $300-500 a month we think.

    Questions
    1) If he fills out a i9/w4 form and becomes a employee of the temp agency will he lose her unemployment?
    2) If he does not lose his unemployment how much will unemployment take out?
    3) If he goes over $1000 in a month will unemployment cease?

    I know for California, he would lose his unemployment benefits. If he takes the part time/ temp job and is let go soon after, he might not get any unemployment benefits. The clock for earning points for unemployment, starts over once you start any job. Also for California, you do not have to accept any job that pays less then unemployment.

    To me, working part-time while on UI is very complicated. For the most part, it can cause problems that someone with little UI experience won't be able to deal with.

    The system was designed for you to find a job that is comparable to the one you had before, and part-time temp work will generally be unsuitable if he doesn't want to do it.

    It depends on things like how long have you been on UI. You have to pay attention to dates because you have to exhaust your claim before your benefit year end, or you lose eligibility for the EUC extensions that are in effect now until the end of 2013. Working part-time effects all sorts of things like the dates, when you exhaust, it's a new job that then can create another separation issue. You can find yourself with no part time job and no UI check or delayed UI checks for weeks while they investigate why you aren't working that part-time job anymore. Any week you exceed your UI earnings exclusion your claim closes, and then you can spend days dialing in to overwhelmed call centers to get your claim reopened. For the most part, I've just concluded it's better to just collect your check, and look for a job that is as good or better than you had before, and move on with your life.
