My question involves a traffic ticket from the state of: Ohio
I was at a 4 way intersection with a traffic light, attempting to turn left. The light turned green, the first car opposite me went straight, the second car was turning left and the 3rd car was a cop with his right turn signal on. When the second car started its left turn i started my left turn, onto a 2 lane road and i was turning into the left lane. The cop then accelerated and tried to turn into the left lane as well, which in not a legal turn i believe as you are supposed to turn on to the nearest lane, so he should have been turning onto the right lane while i was almost fully on the left lane. Well he sped up, slammed on his brakes to avoid hitting me as he made his illegal turn, then pulled me over and gave me a ticket for failure to yield.
When looking over my ticket, i noticed he put down Ohio Revised Code 4511.41 as what i violated. Here is what that ORC reads:
(A) When two vehicles, including any trackless trolley or streetcar, approach or enter an intersection from different streets or highways at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.
(B) The right-of-way rule declared in division (A) of this section is modified at through highways and otherwise as stated in Chapter 4511. of the Revised Code.
(C) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
I did not violate any law on ORC 4511.41, after looking through the codes, if any violation i had it would have been code 4511.42. I plan on defending myself in court. advice?
