    Default Restraining Order Issued, then Protected Person Got a Job at the Same Workplace

    My question involves restraining orders in the State of: Colorado. What legal action can be taken against a female who chose employment at the same place as the man she put a restraining order on? Yes they're scheduled some same shifts also what if anything can be done concerning the employer who allowed this?

    Nope - you'll likely find that the RO does NOT preclude her from working in the same establishment.

    Well thank you again one last question and im sorry im just trying to make sure this man is safe from more legal problems. Will he be in violation if he has been at work all day when she comes in? Last one promise.

    This is tricky for him - even if there would not be an issue were the petitioner to arrive for work on time, he may have to leave work to avoid violating the order. If this is going to be an issue, he will have to consider making his employer aware of the possibility as they're not going to be happy if he walks off the job early when his ex- shows up at the workplace.

    Does the order prohibit his being at her place of work? If he worked there before the order was signed, and she started afterward, he may want to go back to court for clarification of any such language in the order, lest the police become involved for some reason and interpret it as "he's never to be at her place of work". He can also seek modification in relation to any shifts they share, given that the petitioner voluntarily sought out employment at the same work place and is accepting shifts for which she knew or should have known he might also or already be scheduled.
