    Default Divorce by Publication in Nevada

    My question involves a marriage in the state of:Nevada


    I know how to serve a summons and complaint for divorce where the defendant has a known address. What are the procedures for service of process through a newspaper? NRCP, rule 4 isn’t all that informative.

    What is the step by step process? How must the publication read in the newspaper? What would the contents of the motion for publication and the proposed order have? How is return service done?

    I am doing this divorce myself and have no idea where my wife is other than she resides out of state in Washington. I lost contact with her over 7 years ago.

    Are there free sample forms and instructions online somewhere beside the generic nonsense offered by the Nevada courts?

    When serving by publication, the Summons must be published verbatim in the newspaper once a week for four weeks. Once publication has been completed, the newspaper will provide a return of service with a copy of the Summons ad published, showing the dates on which the publication ran. The Motion for Service by Publication is filed to demonstrate to the Court why regular service cannot be made upon the Respondent.

    Rule 4 states that the Order for Service by Publication shall direct that the Summons be published in a newspaper in the State of Nevada, but also provides that the Court may require the Summons to be published in a paper outside of the State of Nevada if it determines that to be necessary to give the respondent adequate notice. Generally, a court will require a Summon to be published in a newspaper in the county of the other party's last known residence. Therefore, if the other party's last know residence was in Washington state, it's most likely that the court would require the publication to be done there.
