My question involves labor and employment law for the state of: Kansas

My husbands employer laid him off at the end of September 2012 and he lost his insurance coverage on Oct 1. After numerous calls to different people he finally got his cobra package Jan. 5. During the month of October he had to go to the ER and have a minor surgery. It is my understanding that they have 15-45 days to get the COBRA notice to him and after that there is a fee they must pay him and the IRS for every late day. It is $110 for him and $100 for IRS. Is this something worth pursuing. The first time we called was Oct. 10th and he was told it should come and given another number. I called November 18th and was told I'd receive an email as to why we haven't gotten it yet. I contacted the department of labor as well as the insurance commissioner in Kansas. I also know they could be on the hook for medical bills but we have the cobra now we just need to pay 1336 to get him up to date.

For the month of October he owes almost 10,000 in medical bills.
