My question involves labor and employment law for the state of: Claifornia

Hi there,

Earlier this year I was placed on short term disability and exhausted 12 weeks of FMLA. I returned to work a couple months ago and my condition is back, which means that my doctor may put me out again.
Since I am no longer eligible for FMLA, what would my company (a Fortune 100 company with over 50,000 employees) do? I'm aware that they don't have to protect my position and will probably get it filled.
Would I still be kept on payroll (with no pay) until I return then asked to apply for an available position? (I'm asking to determine what would happen to my medical benefits).

Also, if they fire me because I am not able to work and I don't have FMLA, would I qualify for unemployment or disability?

Thank you
