My question involves employment and labor law for the state of: After years of being a temporary employee in a lab quality assurance position, I was hired on to do Consignment Inventory for one of our companies biggest customers. It will be 2 years at the end of January since I held this job title. I signed an annual payment and job title contract for. At the end of September of 2012 I was informed the company was cutting back (even though we're still busy and not losing money) and I was to do the lab in the morning and the consignment job in the late morning until I wanted to leave. The lab position pays more than the position I currently hold, and where I spend most of my hours, as I hardly have time now to do the job which I was hired for. Since I spend little time doing the job which I was hired for, I have received harrassment from current coworkers or harassment from other coworkers saying I don't do the lab as well. The lab shift does not begin until 5:00 am, but to get all the stuff I need to get done, including supervisor duties passed along to me during this time, I need to be there around 3:00 am. I received a good preformance review and I asked my manager about payment compensation. He told me I was, "saving the company money" and I should be happy. I no longer have a home life and more times than not become irritable. The stress of both job titles, working an irregular schedule, having no social life has taken it's toll.
What are the proper procedures to receive equal pay for equal work? The guy who currently holds the lab position was a temp like me, but didn't have to go through the grueling interviews as I did for my job and get dressed up. My manager told me he wasn't sure if I would come to the interview dressed in a hoodie and jeans (which I normally don't wear), even though this guy every day wears Old Navy Carpenter pants and a washed out navy blue tshirt. He looks like he rolled out of bed and came to work. He is gay and it seems like everyone walks on egg shells for him. What they didn't know I was gay as well, and now that they know they seem to be letting loose of the reigns. I never told anyone because I wanted to be treated equally amonst by peers, but I can hardly get that.
What are also the procedures to go about receiving short term disability due to stress or using sick pay for that reason (I have almost 3 weeks of full time sick pay)? This past month due to issues because I could not do the job in which I was hired for, I missed personal well being appointments (therapists, doctors, chiropractor) that keep me adjusted and balanced.
