    Default Determing Damages from a Car Accident Caused by a Drunk Driver

    My question involves a traffic accident in the State of: massachussets

    Hi all.

    ok was 8am i parked ( pick up truck with a 16" metal trailer with mower machino on it ) on the side way street, so i parked the truck get out of the truck and than i open the trailer gate, i went back to the truck and i was stand btwin the trailer and truck, i was next to the trailer hitch take the tools out of the truck, i dont hear anything no brakes nothing, i just hear the big BOOM and i was at the floor with extremelly pain ( i coulnd move my right leg and i counld move my hole body was in crazy pain that i never felt before.. a gay call the police, ambulance came i was take to ER , was in so much pain i can beverly talk. so they take me to a room for a cat scan, xrays and a lot of pain releave injection....after 6 hours they said x-rays and cat scan show no broken bones, i was so happy even with the pain but i knew nothing was broken, so i went home and i call my friend ( he was on the other side and saw everything happen...( a lady hit back of trailer and the trailer hit and trow me on the ground hard)
    next day o thougth was ok i never had car accident and any type of injury before so i tought was ok..but the pain come back crazy in the next day. so i went back to hospital and stay there all day..again they did xrays and ct scan nothing show. only bruises, lumps, muscle pain, shoulder pain, mid back pain, low back pain and knee pain...
    after 6 days of accident i start doin chiropract sessions and after 2 months i still doin, also i went to orthopedic doctor that send me to do MRI, shows a litle thing in my knee but he said should be back at normal in 30 days...my chiropract doctor just told me today i will need at least another 8 weeks of tretment..im very frustrated with all this, sinze the day of accident i cant sleep well, this pain in my lower back is killing me sometimes comes on go, i cant work, i cant go to the gym the i used to go every day i is most thing i love to do, i cant play with my kids the same way i used to play, i start fight with my wife cause im so estressed...
    ( BEFORE I FORGET WHEN I SHOW UO AT THE POLICE STATION TO DO A REPORT I WAS TOLD SHES BEEN CHARGE FOR DUI, YES THATS RIGHT WAS 8AM ON WEDNESDAY AND SHE WAS DRUNK 57 YEARS OLD )

    so my question is when i finish this tretment how much should i ask her insurance co for settlement.? what i do if she has only 20k limit policy.? i dont know her limits yet.

    medical bills is about 22k from the hospital
    3k for MRI
    and total of 4 months chiropract treatment.

    sorry for my whritting im not the good in ingles

    You apparently incurred painful but otherwise minor soft tissue injuries, with no serious injury. That gives you a better case for recovering your medical expenses than for recovering a substantial amount of money for pain and suffering. The details matter, and there's no formula we can direct you to, so you need to try to be realistic, negotiate, and see what offers you get and what you can work out.

    You can expect that the insurance company won't pay a penny beyond the policy limits. We have no way of knowing if the driver has assets that could be reached beyond the policy limits, or how realistic it would be to try to reach them - if you're interested in settling, although there are exceptional cases in which an at-fault driver will agree to contribute toward a settlement, odds are you're going to be settling within the policy limits.

    Document your medical bills to the insurance company and see how they respond. If the bills have been fully or partially paid by insurance, keep in mind that your insurance company may have a lien against your recovery.
