My question involves landlord-tenant law in the State of: California
Last week water leaked from above the door. The landlord did some repair work on the roof but made it worse. Now the ceiling leaks. I signed a simple rental agreement saying that if I live for less than 6 months, the deposit will be forfeited. There are still 2 weeks left until that 6-month limit. The agreement does not provide for moving expense in the case the house (actually, a room in the back house) is inhabitable. Can I now tell the landlord that I am moving out today - because of these leaks and get a full refund of my deposit and the rent for the remaining days of the month (I pay in advance) plus some moving expenses? If so, how is the moving expense calculated? And can I pay the rent up to today but move out a few days later? I mean, the room is leaking and thus inhabitable and I need time to find a new house. Also, this is a month-to-month lease and the agreement says I need to give one-month notice before moving out.
