    Angry Interstate Child Support Modification

    My question involves child support in the State of: CA and TN

    I live in TN and my ex and kids live in L.A. County CA. I have tried a few times to modify my support order with no success. I am currently paying about $400 more than what I should be. The State of TN will not help me because they are too afraid of CA. I have sent the request for modification to CA multiple times and never receive a response. My ex refuses to let me see my children (because she will not agree to share the cost of transportation), she has been unemployed for over 3 years and lives with her parents. HELP!

    What's the basis of the modification?

    What has changed since the original order was put in place?

    Have you actually submitted the correct forms for CA?

    If all Tennessee is doing is collecting support pursuant to the California order they are not going to help you because they have no jurisdiction over the amount you're ordered to pay. They're simply enforcing the out-of-state order.

    Then it sounds like you're doing something wrong.

    That can also be phrased, "I refuse to visit my children unless mom pays half the cost of transportation." Also, if it was you who moved away it would not be at all unusual for you to be made responsible for the increased cost resulting from the distance you created. So tell us, what does the visitation order say about transportation costs?

    If you believe you have grounds to petition for custody, you may do so. If not, or if you choose not to seek custody, it doesn't matter.
