    Default Can You Be Legally Separated if You Share a Home

    I want to know can a couple be living as man and wife in the same home in the same bed and be legally separated? My husband is wanting to do this to protect our assets, in case my credit card debts get more out of hand.
    I admit is a problem and working toward curing that problem.
    If I sign away rights to home and everything we own, do I have rights if divorce or death occurs, which I pray doesn't. I never want to divorce and my husband says he doesn't.

    I appreciate any help you can give me!

    To the extent that your state permits, it's technically possible for there to be a legal separation order in place. But if a husband and wife live together as husband and wife... it shouldn't be too difficult to refute one spouse's claim that the couple was actually separated.

    If your husband is worried about your debts, it should be possible for you to separate most (or perhaps all) of your financial obligations without separating. Depending upon your state, there may be a continued obligation for certain debts, such as those incurred for necessities of life (food, shelter, necessary medical care).

    I hope you have cut up your credit cards. Have you tried a debt consolidation company? They help with getting the credit card companies to stop the interest, so you can start taking care of the balance. I do not know if you can keep the cards or not??

    Thank your for your help! I appreciate it! I know lawyers have made my husband more suspicious of my debts. Advising him to close our bank account and opening one with his name only. They convinced him, I might be stashing money and running!

    Far from the truth, nothing I have in debts was at all for ME! Grown children that need help sometimes, my 12 year daughter, buying clothes, etc.
    3 girls cost a lot of money, a wedding 2 years ago. I've tried to take care of it all myself.
    Then I was suspicious of him, thinking he's trying to get everything in order to leave me. It hurt and scared me. But, it's backfired on that lawyer, it's opened my eyes of loving my husband more and not wanting to lose him.
    We've actually gotten closer, but deep down still a fear of losing him.
    That's why I'm fearful of being homeless, if someone came along and took my husband from me.

    If credit card debts are only in my name is he liable for the debts at all?
    They aren't even in his name at all.

    Thank you for the advise of the debt consolidation! I do have excellent credit so I've transferred balances to 0% interest for a year. And I'll continue to, until paid off. And cards are put away, not cut up, because they will need to be closed when paid off.
