    Default Public Intoxication Charge, Did Community Service but Still Found Guilty

    My question involves criminal law for the state of: Virginia

    I was arrested for Public Intoxication (18.2-388) this past year. I went to court in July, agreed to do Community Service, filed all the paper work with VASAP that same day. Turned in everything including my 25 hours by September. I recently found out that I was still convicted of this charge (and it also says "Guilty" online).

    I did not show up to my court date in November since I was told by the Judge that I wouldn't have to if I was completed everything by then. This charge was out of my mind since I no longer live in the area and completed my Community Service. Aside from that, I completely forgot about the charge until now due to health problems that have been taking up most of my time outside of my job. I have called the VASAP but their office has been closed for the Holiday. I have not gotten any communication from them since they received my initial paperwork.

    Is there anything I can do to get this corrected on my record? I'm a recent graduate with a job, but want to apply to graduate school in the near future. I don't want to have this charge on my criminal record, since it may hurt my chances of getting into grad school or getting a job later in life.

    You need to contact the court. While your case is merely "deferred" until you complete VASAP/CS, normally you do NOT need to show up for the deferred date to get the charges dismissed. HOWEVER, if for some reason the records that you finished the conditions imposed doesn't make it to the court and you don't show up, they have no little option but to find you guilty (or issue a warrant for your arrest).
