You and your lawyer petition the court for exclusive possession and, if your ex- won't agree to move out, the judge will decide who gets to live in the house while the divorce is pending. You and your lawyer will presumably assert that the home is your premarital property, possibly with the marital estate including the equity, and if you and your ex- cannot agree on how to divide the marital estate and about what constitutes separate property you can have a trial and have the court decide the issue.
So as of now he has the right to live there. I can't legally get him out until the divorce is over? If the judge rules my favor?
How do I go by filing for exclusive use of the house. Especially if I'm there and he has other people living in the house right now. I just don't understand why he has so many privileges to the house and I got it before we got married and he is not on as a co borrower. This case is taken forever here. I feel there is no law to help me at all and he just sitting back taken advantage of me. Can someone help me understand please and he has filed a petition to stay in the house
