    Default Are You Responsible for Your Friend's Shoplifting if You Know About It

    My question involves criminal law for the state of: Minnesota

    So a buddy and I went to a Festival Foods to score some cough syrup. Before we went in I told him I wasn't going to "shit where I eat" because I lived nearby so he would be the one concealing the item, and I would be the guy who bought the little debbie snacks. When we found the aisle with aforemention syrup, my friend was unsure of which syrup to snatch, so I pointed to one and he concealed 2 bottles of it. While he was snatching it I was trying to block the view of anyone who would walk buy. Once he had the syrup I looked up to the security camera that I hadn't noticed, and it definantely had a clear shot of my face. I am unsure if the camera got a good shot of him. Anyhow we got away with it, probably because I am a regular at the store. I am 17 with a paraphenalia charge and possesion of marijuana.

    Just about 20 minutes ago a cop slowly passed by my house, then proceeded to to park next to my house at an abandoned place with a direct line of sight to me smoking on my porch while I was wearing the same hoodie that I assisted my buddy in. I would have approached the officer got his name and badge number to file a complaint, but its after curfew, and I'm worried about the syrup incident a few days earlier. There is a small chance he could be watching due to the fact that I urinate off of my deck quite frequently. Pedo or strictly in lue of his career.

    Questions:
    Am I guilty by association because I was clearly there with my shoplifting friend?
    If so, does Dxm (the psychoactive ingredient in the syrup) stay in my system & will I get a piss test if I do get convicted?
    And could said piss test lead to some type of treatment?
    Also let me know if I'm just paranoid as hell.
    *edit* And what would I be charged with? Shoplifting?
    *edit* Will it be expunged when I turn 18?
    *edit* I'm going to guess this won't help, but if my friend was deemed autistic as a child (and he's clearly not now)(and by the state) would it be wise to mention that in court..I'm fairly sure I won't be ratting on my friend unless this will seriously screw my life up. And manipulating an autistic person sounds seriously messed up. (I wouldn't have guessed that he was, if he hadn't told me)

    You're not guilty by "association." You are guilty because you participated in the crime.
    Whether Dextromethorphan is detectible or not depends on what test they use. Most of the standard ones will not detect it. However, between DXM itself and the other stuff present in the OTC preparations of it, if you have been hitting the bottle in the quantites it will take to get hallucinogenic effects out of it, you're likely to trigger positives for opioids and even PCP.
    You will be charged with THEFT. Fortunately, due to a quirk in the law right now in Minnesota, you're not going to be hit with the felony version for stealing drugs.
    Your friend being autistic isn't likely to help his case and it is certainly NOT going to help yours.

    If you are tried in an adult court (very possible given your age and your drug priors), the charges will not go away just because you turn 18.
    I would have a frank talk with mommy and daddy and get a lawyer. You're going to need one.

    The officer is free to park and sit where he chooses. Your guilty conscience is irrelevant.
