Request to Modify Custody Going to Court Instead of Mediation

My question involves a child custody case from the State of: montana

I currently put in a modification of my patenting plan to the judge. Now usually they make you go to mediation and solve it. But this time the judge is making us go to court. Could this be good or bad since I put in the change

Well the reason I am changing it is cause the father cant stick to our p.p he is always changing times or dosent have a ride because he dosent have a license and its been like this for two years I try to work with him. But we live 60 miles away and me ending up driving the whole way instead of meeting him half way has become an issue I feel that if he cant meet me then why should I pick up his slack?

Right now its Thursday at 130 till Sunday at 130 my son is 22 months. The father works Thursday nights till 430am. And does not come to get his son Thursday his gf does. Which I think his father should have to be there to pick up and drop off. Since my son already cries enough when he has to go. Or the father cant take his son cause he dosent have a ride. So I asked for e/o weekend fri to Sunday keeping everything else the same meeting half way. And holidays split

What exactly is wrong with the girlfriend doing the pick up?

Well my son is almost two and dad is never there. And I think for our son he should be. And I understand if it wasn't for her the father wouldn't see our son cause he dosent have a car or licenses. But the girlfriend cant follow the times either. I know stuff happens in life. But everyweekend? Cant the judge set something more workable for them? I'm not asking for a huge change or anything that's not fair to our child
