My question involves landlord-tenant law in the State of: Utah
I signed a contract in late November to rent an apartment. At the time we signed the contract, which was the same time we paid the deposit and December's rent, we verbally contracted that the window in the bedroom with a large hole in it would be fixed so it would be safe when we moved in. It is now December 14 and the window is still not fixed. We decided with the landlord that we could terminate our contract. The landlord will give us our deposit back but not December's rent. Can they withhold our December rent from us when they were the ones not upholding their side of the verbal agreement and when there is still a hole in the window keeping us from being able to move in?
