    Default Realtor Mistakenly Changed Locks on My Storage and Disposed of Property

    My question involves personal property located in the State of: Florida
    A realtor thought my storage unit belonged to his new tenants. He had a locksmith change the locks on my storage unit (unattached to my condo) and advised his tenants to dispose of my personal property. There was over $3000 in my unit (some of which had great sentimental value, as well). No effort was made to find me. He was under the impression that it belonged to the unit he was managing which had gone through foreclosure. Wouldn't he have been required to locate the former owner of his condo even if it was foreclosed on? He has been pretty uncooperative in settling with me. He advises me to file a claim with my homeowner's insurance policy. A police report was filed and he acknowledged his actions.

    I don't think the dispute at this point is over his fault - I think he's skeptical of your claimed damages and believes he'll do better dealing with your insurance company as opposed to dealing directly with you.

    What were the items with "great sentimental value" - are we talking childhood art, family pictures, great grandma's Hummel collection....

    I think his insurance should have to pay for his negligence, not mine. He may indeed dispute my claimed damages, but I looked up replacement value of everything that I posted with the exception of Christmas ornaments. I guessed at how much it would cost to replace them.

    What were the items with "great sentimental value" - are we talking childhood art, family pictures, great grandma's Hummel collection....
    Ornaments that had been collected over my entire adult life including items given to me or made by my children. There were 3 handmade stockings that took my mother over 300 hours each to make. You can't replace those, but they were treasures to me.

    You have two options. You can sue him or you can let your insurance company handle it.

    Sentimental value you're going to have a hard time collecting on, sorry. Courts only award real damages.
