    Default Can You Get Pain and Suffering or Punitive Damages for a Will Contest Case

    My question involves estate planning in the state of: Kentucky

    Hello, could someone please tell me if a jury can award pain & suffering or even punitive damages in a will contest? I've been given conflicting opinions by attorneys.

    One says that if the jury finds trickery or fraud was involved and/or other "black heart" issues, the jury can make those awards. Another attorney says that a jury in a will contest can never award those things because those are only involved in criminal cases.

    I would love to hear your opinions, thanks.

    You are the person contesting a will? And you want to recover "pain and suffering" and "punitive damages" from the estate?

    You need to share some facts. For the most part, people are free to disinherit whomever they wish to disinherit.
