Have you reached out to the local domestic violence outreach program to talk this over with them? Local advocates generally have excellent knowledge of how the court in your jurisdiction works and how judges have ruled in cases similar to yours. They can also help you with safety planning and a lot of practical matters like housing, etc, if needed. NY is known for being tough on DV, but the reputation of the state isn't nearly as helpful as the reputation of the judge in your case. This is where a local advocate is priceless. Many advocates will assist in the process of getting a RO, so if you aren't already working with one I strongly encourate it.
