My question involves employment and labor law for the state of: MA
I have a question regarding repaying tuition reimbursement after terminating employment. I worked for this company for 10 years and they paid approx $5000 in tuition fees. I signed the form stating that I would repay if I terminated my position with the employer, under the impression that I would have to work 12 months after graduating for a 0% payback. I graduated in May 2011 and terminated my position in June 2012. When I left, I was given a letter saying that I would owe $1300, because I was terminating between the 12-24 months that was required. (The original stated something like, if you leave within a month payback is 100%, 6 months 50% and 12 months 0%). Now, of course I don't have the original form with the payback provisions, I was emailed a copy but never printed it out (duh, on my part) and I was never told of any changed made, even when I resigned for a new term of reimbursement. All I have to go on is, that I remember saying, "It won't be that bad, I can work for a year." So, I guess my question is am I better off just paying it back?
On a side note - I terminated for multiple reasons: sabotage (proven!), disrespect, not being paid OT that was worked... It's a good company, until you stand up for yourself.
Thanks for reading and for any advice!
