    Default Bullied by a Supervisor Who Wants Me to Quit

    My question involves labor and employment law for the state of: California

    My supervisor began bullying me and tried to get me to quit my job of 20 years. Because I am in a protected class i filed a complaint with the state EEO office-which they accepted. However, they did not have time to investigate. I notified my HR dept that i was being harrased by my supervisor and i felt it was because of my race-discrimination. I was skipped over for promotions and advancements -(the White or Asians were not) I am the only Hispanic in the departmentand was subjected to a different set of rules and even moved from my desk away from co workers. Supervisor made false accusations of me. Which I disproved time after time and actualy pointed the culprits of the erros -who happened to be White. She continued to harrass me until i had a nervous breakdown. They tried to get me to go on workmans comp. I declined. After accusing them of discrimination..HR calls me and tells me that due to no more work I am being let go and they called security to escort me out of the building. I had recently turned 40. Is this a retaliation case? discrimination case? thank you

    EVERYone is a member of at least two protected classes (everyone's got a race and a gender).

    File with the federal EEOC as well. You'll eventually get a right to sue letter from one or both.

    No stranger can declare whether you have a discrimination case, and I'm not sure why their view would matter. You clearly believe you were discriminated against because of your race, so ... proceed accordingly.

    Your implication that anyone who is treated negatively at work has a valid gender and/or racial discrimination claim just because everyone has a gender and race is profoundly incorrect.

    I think he was implying the opposite - that is, that you cannot assume that mistreatment is racially motivated merely because you are from a particular racial / ethnic group.

    Yes but why the mistreatment? The different standards?
    If I "feel" it may have been racially motivated do I really need a "smoking gun" to prove this? The fact of the matter is I am in a protected class. If I were not then the supervisors actions could have stemmed from just about anything. But she began to treat me differently than the others (mainly the White employees and the Asians). She (who is white) began a year long attack on me. Embarrasing me in front of co-workers in meetings, blaiming me for mistakes that never occurred, blaming me for computer system failures blaming me for just about everything to get me to quit. She (who is white) promoted the asians and the whites over and over. To make me feel better she would walk around the office and greet everyone in English and to me she would say hello in Spanish? And brought Mexican Pastry. This wasnt a one time incident-it was a year long battle in which she ultimatley got what she wanted and had me 'laid off" while our company had numerous temp workers walking around doing nothing. MY job was given to an asian woman-the next day. So what am i supposed to infer from her actions? That she was having a bad day? What I am trying to determine is if I have a case related to discrimination, age discrimination or retaliation? BTW I didnt get laid off and THEN run out to complain to EEOC. I had filed the complaint form and met with the caseworker 2 months prior to being "laid off".

    Sometimes when a supervisor singles out an employee it's due to the supervisor's not liking the employee, due to the supervisor's being a bully who always singles out an employee, due to the supervisor's having a friend who he can't hire into the job until the employee quits.... it's not as if there's only one possible explanation when a supervisor treats somebody differently.

    As indicated above, everyone has a race, everyone has a gender, and everyone has a national origin; therefore everyone is in at least 3 protected classes, so called. You need more than a "feeling" to prove motivation.

    I dont think I need to prove anything. HER actions speak for themsevles. The supervisor and HR "laid me off" for no reason at all after 20 years and a month after turning 40. Discrmination can take many forms and its not all the time have to be outright remark. I think people on this forum are missing the point here? How is disparate treatment valid here? It isnt. Why ARE THE ASIANS AND WHITE employees subjected to ONE SET of rules and I being the ONLY HISPANIC FEMALE who is 40 subjected to another SET of RULES and why was I let go from my JOB when I was a PERFECT employee? WHY is it that i can point to several WHITE employees who have received promotion after promotion and wage increases when we are doing the EXACT same JOB?
