    Default Return of a Pet Deposit

    My question involves landlord-tenant law in the State of: California

    My apartment management required me to pay pet deposit of $500 for my dog. My lease was ending next month but I paid it since the mangement said they will return the deposit when I move out.
    I extended my notice after my lease ended on a month to month basis. I have recently moved out (with my dog) but my roomate still lives there.

    Question is
    Can I ask them for my pet deposit??

    Would they into the unit to check /inspect for my dog?

    My roomate has a small rabbit. Are rabbits considered pets and do they also require pet deposit?

    When they go to the unit for the inspection and see the rabbit would they not refund me my pet deposit?
    Or would they return my deposit and have her pay $500 seperately for her rabbbit?

    You can ask them for whatever you want. However, asking and getting are two different things.

    If the person holding your deposit has a brain in his head, of course they will.

    Are you serious? Yes, obviously a rabbit is a pet. As for whether a pet deposit is required for a rabbit, read your lease.

    If you argue to them, "I should get my pet deposit back because I'm moving out and there won't be any pets in the unit," then they go into the unit and find a pet, they're apt to say, "There's a pet in the unit so we're keeping the deposit."

    It's going to depend upon the nature and terms of the lease agreement, to which we have no access. They may be apt to say, "Have your roommate give you $500, and we'll refund the deposit to her when the unit is vacated."
