    Default Custody for a Newborn Baby

    My question involves child support in the State of: Texas

    i have a newborn baby who's 5 wks old. Me and her father were never married. He wasn't around for the pregnancy either. Since my daughter was born hes only seen her twice. His family knows about her but haven't made the effort to know her. For that reason, i dont see why she should be around them.
    he works out of town (in Dallas) and rarely has a day off.
    Im planning on putting child support on him but i dont want him in her life. Is there any way i can do that? If so, how?
    Also, what should i do if i dont know where he works or how much he makes? I've got the papers to send them i just didn't put that info because i didn't know it.

    Nope. When you chose him as the father, you pretty much guaranteed that he'd have rights to access to his child, IF he chooses to attempt to exercise them. Unless you can prove to the court's satisfaction that he somehow presents a DIRECT and IMMINENT danger to the child, dad will have the court's support in establishment and exercise of parental rights, and of the CHILD's right to two parents, even one who hasn't shown a lot of interest.

    Since you weren't married, dad's right to access to the child doesn't exist in a meaningful or enforceable way until dad seeks a visitation order. You have every ability and right to tell dad "no access for you buster". The day you file for child support, that's the day to expect him to seek court ordered visitation. But realistically, no, you're not going to get dad's money for support AND prevent dad from having a relationship with his child, if he chooses to do so.


    Also, what should i do if i dont know where he works or how much he makes? I've got the papers to send them i just didn't put that info because i didn't know it.
    As part of the process of establishing child support, the court will require dad to disclose that information so that the court can evaluate that information as part of determining the appropriate amount of his support payment.

    there is law in Texas that allows a father to relinquish rights to a child. I do not know the specifics of it offhand but if both of you wish for the father to relinquish his rights to the child, it may be something you should look into.

    Unless Mom is completely self-sufficient, that's not going to happen.
