    Default Defaulting on Student Tuition Debt

    My question involves collection proceedings in the State of: California

    Hello I went to a private university for a semester and left due to it costing too much. i had a collections agency calling me and we started a payment plan. for about a year i made my payments on time. I asked last year for a letter describing all my payments and what was left. I never received such letter and didnt hear from the agency for over a year. My life changed in that year i had an unplanned pregnancy, lost my job and went on welfare, Now they are contacting me again and the debt is back where i started, its as if i never made any payments at all. Im still on welfare although i did just get a a part-time job. I make about 100 a week or so. my question is if i cant pay them right now and the keep asking for money now or they'll sue what can i do? should i file for bankruptcy? I have no property or anything of value. i should add that I'm also paying back my student loans and i was just in the hospital for 2 weeks so i havent been able to work. My debt is about 14k when I had already brought it down to about 6k. Should i contact a probono lawyer? should i ask to work it out? (althought ive done that before and they were adamant the wanted an amount i couldnt afford)

    You will not successfully file bankruptcy on standard student loans. Your irresponsibility by getting knocked up and ending up on welfare is not their problem. Had you continued to make payments, you would not have incurred all the late fees and raised interest rate. I suggest you put on your big girl panties and go to work.

    Odds are your student loans aren't dischargeable in bankruptcy; you would have to share more information about the loans. You can discuss the details with a bankruptcy lawyer.

    With a lot of lenders you can get a statement of your payment record and balance online. When you choose not to pay your loans, you can quickly rack up late fees, interest, collection fees, and the like. Check the lender's website and see what you can find out.

    I wouldn't put 1 dollar on a 10000:1 odds of it happening either ...
