    Default Trial by Declaration and Due Dates

    My question involves a traffic ticket from the state of: California

    I contested a VC 22349A citation by Trial by Written Declaration. The TBWD was submitted in early October (on the due date) and I was told by the court clerk that I would be getting a response in about six weeks. So far I have not received a reply. The court’s website provides the following information:

    Name: xxxxxxxxxxxxxx
    Court: Los Angeles County
    Violation Date: 5/14/2012
    Initial due Date: 8/04/2012
    Case Status: Case Closed
    Disposition: Fine paid on 10/20/2012
    Last Action: Court trial
    Last Action/New Appearance Date: 11/13/2012

    I’m not exactly sure how to interpret this. Does this mean that the officer has responded and the judge has ruled against me, or is it the other way around?
    I appreciate all your help.

    There is no particular set of codes that any court uses to signify any particular stage or outcome on the TBD status screen. With that said, and if I were to guess, I'd say you lost your TBD (case closed) and the bail you posted was applied towards the payment of the fine (fine paid).

    Now, I offer no guarantees so unless or until you go to court, ask and are given an answer by the clerk, or receive the notice by mail, there is no telling if I am correct or not!

    There is no time limit on how long the court can take to review a case, and though the rules require the clerk to notify the defendant of the outcome within 90 days, as long as you are still given the opportunity to elect a TDN, there is no recourse for you if they took longer than 90 days.

    The one thing you should verify is to make sure the court has your current mailing address either by checking previous correspondence you received from the court or by looking at the citation itself!.
