    Question Extradition for a Bench Warrant on a Misdemeanor After Serving to Weekend Sentence

    My question involves criminal law for the state of: District of Columbia and Maryland

    My boyfriend is in the military and moved from DC to MD earlier this year. His DC license expired and he was pulled over in both DC and MD for driving w/ an expired license (expired out of state in MD) and was asked requested to appear in court. He was away on exercises w/ the military for both dates and rescheduled dates and a bench warrant was issued. He requested a new trial date in both DC and MD. In DC the date was granted and he was sentenced to a weekend stay in jail. Upon his release he was held in DC because of the outstanding warrant in MD (MD denied his request for a new court date). He's now being held in custody awaiting word on if MD wants to extradite.

    What is the likelihood the MD will extradite? He is up to date on fines and has since gotten a new MD license. If he is extradited how long will that take and will he have to serve additional time in MD for such a minor offense.

    Given the rather short distance, I'd say they are likely to extradite. Is his command aware of this mess? If not, he needs to inform them.

    I don't believe so. He's in the Army Reserve and is not currently on active duty however he was earlier this year when the trial dates occurred. This just seems so ridiculous because he owes no fines and they have issued him a new license. He's lost said license TWICE in the last month and each time got a duplicate at motor vehicles with no problems.

    So my boyfriend was arraigned yesterday (Monday) and has waived an extradition hearing and is volunteering to return to MD for the bench warrant. He has a Status Hearing scheduled for this Friday. What is likely to happen at this Status Hearing? Will they make a decision on when he will be transferred to MD or might he be released? I'm trying to figure out how much longer he is likely to continue to be incarcerated considering his offenses are traffic violations.
