    Question Can Arrears Be Taken from the Child Support Payor's Tax Return

    My question involves child support in the State of: Indiana
    My husband went to court in November. His child support was raised and he contested it.so he is still paying the old amount and has no arrears. There was a continuance put on the hearing until January. My question is can the state take his tax return for arrears if it is found he will have to pay the new amount that was decided in Nov?

    The court order is what was just ordered. UNTIL another judge orders it differently. So if he was ordered 800 a month and the old amount was 600 and he is paying 600 there is a 200 dollar arrerage building up. They can set up an income tax intercept any time they want. If the amound is 200 or 2000. How long ago was it raised and has he been paying less?

    Since this just happened in November, and a continuance granted until January, I doubt you'll have to worry...this year.

    I agree, at least as far as federal taxes are concerned.

    The new order was last week. But he contested it, from what i understand nothing more than the old child support amount will be taken out of his check until after the next court date which is the last week of Jan. Im just worried that the state will intercept his taxes for the difference.

    But then he won't have those arrears (and the interest) hanging over his head!
