    Default Can You Get Emancipated to Live With Your Pregnant Girlfriend

    My question involves guardianship in the State of: Florida my name is kemuel ferrell i am 16 years old unemployed and live in jacksonville i am expecting a daughter in january while my father is open to visits he does not wanna let them move in so we both agreed that moving out is the best option i recieve diffrent goverment checks every month so i wondered would a judge approve me to move out on my own keep in mind my father is willing to let me move out

    Both legal guardians must file the petition in FL, and in addition you must be able to prove to the court that you can support yourself.

    Are you receiving SSDI dependent checks? Your own disability checks?

    Do you understand that the courts will basically look for ANY reason to deny an emancipation petition, and you having a child while you're a minor yourself is really only showing that court that you need more, not less, adult supervision.

    There is a different between moving out and being emancipated. There is no requirement that children live with their parents. There are all kinds of requirements that children not be neglected/abused but absent a court order stating the child must live wiht XYZ person, there is no requirement a child live with mom or dad. With Dad's approval (Mom and Dad's approval if applicable), you can live with your grandparents, best friend, neighbor, pastor, or in the pool house of the King of Sheba. If Dad however, sees emancipation as his way to end his responsibility to you, that isn't going to happen.

    As soon as you move out, you lose any of the check not being provided to the baby. The government is not in the business of supporting minors living away from their parents, knocked up or otherwise. Your only hope is that your parent realizes what a waste you have made of your life so far and signs for you to be married and someone elses problem.

    To answer your first question yes they are my indvidual checks and I also receive survivor benifysfrom my mothers passing and while I unfersptad the rocky conditions. Of my situation I see no reason why not to try thank u
    for responding as quickly as u did any further help and inlsite wouodl

    Okay, if you are emancipated the survivor benefits will cease.

    Did you read the part about you being a very young parent? That virtually guarantees that you will not be emancipated.

    However if Dad lets you go and live elsewhere, that's another matter entirely. But how are you going to support yourself AND your child? And perhaps the child's other parent?

    Agree. Sixteen and pregnant in Florida is a virtual guarantee of denial of emancipation, regardless of ANY other factors.

    You're at the mercy of what your father allows.
