    Question Joining the Army While on Parole

    There was an old thread on here regarding joining the Army while on Parole/Probation.

    A friend spend 23 months in jail for 2 misdemeanors (nothing drug related or anything else considered a "serious offense"), and has been on parole for ~36 months but won't reach his max for another 5 yers. I know it's possible to petition for early parole termination, and we figure he's a good candidate - his PO loves him, he's been dropped to lowest custody, and has been pretty boringly well behaved since he got out.

    At the time, one poster referenced the USAREC manual that said that "Any legal procedure that reduces a sentence specifically in order for him to join the military, makes him ineligible to join
    the military." This was the 2001 update, but there's been an update since then that makes no mention of this rule. There was only one mention of "parole":

    Recruiters are prohibited from interfering with the civilian criminal process. Recruiters will not allow persons who
    have an unpaid fine or are pending charges (including unfiled charges known to the recruiter) to enter the FSTP or
    access FOs until all such restrictions are removed. Likewise, recruiters will not allow individuals who are confined in any
    criminal justice facility, on probation, parole, or similar status to enter the FSTP or access FOs until all such restrictions
    are removed. Recruiters are further prohibited from participating in the release of individuals from such restrictions,
    whether by paying fines, appearing in court with applicants, testifying for applicants, or interceding on behalf of these
    individuals in any manner.
    So basically, is getting off parole in order to enlist all legal/ok now? He's afraid to mention in in the application if it means he won't be able to. Also, is there a waiting period between getting parole dropped and starting the enlistment process? He's in PA, if that matters.

    By my reading of the reg, it only precludes enlistments where the recruiter interferes/influences events. If the court chooses to terminate his parole, then he should be okay to try and get in. He should be aware though that the military is being EXTREMELY picky on who they let in these days. Even a couple of misdemeanors, especially ones where he did time, are probably going to disqualify him regardless of parole.
