    Default Reckless Op Misdemeanor Charge

    My question involves a traffic ticket from the state of: Ohio


    I have never been charged of anything other than two traffic offenses. Both were charged: reckless operation. One was when I was a minor, in my home county. I was doing 30mph over the speed limit. I was found guilty in juvenile court and lost my license for 6 months. That was over 5 years ago. I believe it is well off my driving record.

    About two years ago, I was "chirping" my tires in a parking lot in Toledo, Ohio. An unmarked police car pulled me over, handed me a ticket with a court date on it. I went to court, paid the fines and did not lose my license They actually made it seem more like a joke than a serious offense. I'm not sure whether these would be considered minor misdemeanors or 4th degree misdemeanors. I believe minor misdemeanors do not show up on criminal records/background checks but 4th degree misdemeanors do? I am majoring in college in Engineering and am going for a masters degree. I have also considered things in the future like a Machinist/Engineer MOS Career in the Marine Corps and Concealed Carry License, etc. I've been accepted on renting my own apartment since these issues, I've received federal student loans, and I've bought guns so I never really worried about background checks until speaking with some co-workers recently. I have heard many different stories whether or not these will show up on my background check or not, or if it is even a big deal. I read somewhere about expunging the violation that occured when I was a minor, and something about having to wait until I'm 23. I'm not worried about my driving record, just more so my criminal record. Like I said, from my understand the first violation is well gone off my driving record and insurance companies cannot see it. I do not plan on ever getting a CDL license or driving a school bus but I've worked extremely hard at school and getting good job experience and I've now worried myself sick over these two things ruining my chance at working for top notch companies because they see a MISDEMEANOR charge on my background check.

    Anyone have advice or answers?

    From what you have told us, assuming this is the conviction charge:
    Quote Quoting ORC Sec. 4511.20 Operation in willful or wanton disregard of the safety of persons or property.
    (A) No person shall operate a vehicle, trackless trolley, or streetcar on any street or highway in willful or wanton disregard of the safety of persons or property.

    (B) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
