    Default County Criminal Court Has False Information on Crimnal History Stopping Employment

    My question involves criminal law for the state of: Illinois

    I was charged with MFG of MDMA 15>200 in August 2010
    In May 2012 I took a plea of possession of MDMA 10>15 Class 1 Felony
    My criminal report states MFG/DEL of Herion
    Which has caused employers to not hire me can I file a claim against the county for loss wages?

    My question involves criminal records for the state of: Illinois

    I was charged with MFG of MDMA 15>200 in August 2010
    In May 2012 I took a plea bargin of Possession of MDMA 10>15
    I have been on probation since then.
    I have applied for jobs since August 2010 till Now I found out the reason I have been unqualified is because the charge I put on the application does not match the charge on my criminal background.
    My criminal background stated that I was charged with MFG/DEL of Heiron
    Can I seek damages as well as have them correct it?

    You can start by asking the clerk of the court to correct the abstract of the record to the state, assuming that's where the error originated.

    You're not going to get money.

    Nope. First you'd have to show that the information is indeed factually incorrect. Even though you had a plea bargain, that doesn't always prevent the original charge from being advertised. Second, to claim damages you'd have to show that not only is the information not correct but that someone else relied on that to your detriment. It would be hard to show that the Heroin charge somehow prevented you from getting a job that the MDMA charge would have allowed. Unlikely. Second, you can't claim lost wages on a job you never had.

    Your best bet would be to try to get the record corrected, if it is indeed wrong. If you can't get it fixed administratively at the ISP, you're going to need a lawyer.
