    Exclamation Going to court on Friday the 13th in Ohio

    HI! I am a first time user and want to know some things. A little history about me... about 2.5 years ago i almost died and woke up out of surgery and decided to start living my life. I got married in 2000 to a man who was a control freak and who turnrd out to be really bad OCD to the point of acting out towards me. (IE-if I slammed a door he would throw me to the ground and tell me he was only protecting me from myself?) Anyway, we bulit a house that started out being a $100,000 house and QUICKLY turned into a $450,000. He would borrow money from his mom and dad and want me to do the same thing. We were soooo house poor- I was working 80 hours a week just to keep food on the table. To make a really LONG story short we were about 600,000 in debt and I was hating him even more day by day. After I left him I decided to declare bankruptcy (the only thing in OUR name was the house and he was planning to refinance anyway), and went back to school to get my BSN, and start doing things for ME. It is now coming down to the wire and on Friday the 13th is the day we go to court. All along he has been wanting me to STILL pay for 1/2 the house and 1/2 HIS debt and get NOTHING from the house AT ALL. He makes ~ 125,000+ and I am a nurse on mark to make 38-39,000. Can a judge really rule in his favor? I am going to graduate school in September and will have to quit work because of the CRNA schedule- How am I ever going to move on and get on my feet where i won't EVER have to rely on a man again?
    PLease help! I am sleepless at night and I can't think right.

    If the debt was associated with acquiring the house, with the house as a joint asset, normally you would be responsible for half the debt and would be entitled to half of the equity. If wishes were ponies, I still don't thing your husband would get a pony - I doubt that a court would award him the house, yet still assign you half of the debt.

    OK. Because I declared bankruptcy i have no claims to the house. My pre-marrital things are still in there and some documents. But I giess what I'm concerned about is I feel I am paying my half of the debts eventhough i declared bankruptcy. I am not going to be able to buy a house with out an inflated apr and can't get any reasonable rates on credit cards because of the HUGE amount of debt the house had out us in. So now I was the one who found a way out of the debt and got a fresh start and NOW he wants to put me back in debt all because he never filed (even his lawyer begged him to!!) Do you think a judge would bend more towards him? And does it make a difference that I don't have a lawyer that works in the same county as the judge? (He isn't "homegrown")

    You should get an assessment of your situation from an Ohio family lawyer.
