Are you being charged with a state charge or federal charge? Are you in base housing? I ask since the MP's were involved.

This is probably a misdemeanor charge, you definitely need a lawyer. If u want the best result possible then hire a lawyer and maybe something can be worked out.

Yes, what violation is indicated on the citation (statute number, please)?

Typically this would be a misdemeanor per PC 272, and depending on the base, they will likely cite CA state law rather than a federal statute.

Personally, I would not think the DA (if filed under state law) would proceed with this matter assuming what you say here is verified by what the officers observed or were told the night in question. But, assume it will go forward and consider consulting an attorney.

Upset or not, you now have to address the charge against you. It is NOT a defense to the crime to say that you got a citation and someone else did not, so keep that in mind.

If the DA pursues the matter, you will need to engage a defense attorney. If you cannot afford one, an attorney should be appointed for you on or about the date of the arraignment (the initial court date - likely written on the citation). Do NOT fail to appear in court on the date and time indicated on the citation.

Yes I understand.Me raising my voice at officer have anything to do with charge in court, just don't want the judge to think im an angry person and to charge me with the full extent. No I can not afford attorney, husband active duty, and in school,im just a stay at home mom with 4 kids. I know I shouldn't of let her ride her bike I should of went with her. No court date was sent it just says the address to court, and officer told me I will be getting a notice in mail. Thank you again for all your quick responses!!
