    Default Theft and Receiving Stolen Property Charges

    Ill start by saying my mom drives truck for a garage company and gets gift cards for tips and brings them home for us kids to use. A few months back I came home one night and seen one for Walmart ($25) on the table. Figured it was one she had brought home. Went to Walmart spend like half of it and a few days later my sister had asked if I seem a gift card come in the mail for my 8 year old nephew. Not thinking of the one I thought my mom brought home I said no. About a week later a state trooper came and asked me if I knew anything and I said no not that I've seen. Well they went to stop the gift card and seen it was used. Had me on camera usin that card. When the officer confronted me about it then it all hit me. It was the same card. I felt horrible. So I admited yes I used that card however I didn't know it was the same one. I offered to get the person a gift card in return considering it was a huge honest mistake and it was for my nephews birthday. Well the person that had ordered the gift card does not like me because of my mothers divorce. (Long story) so she pressed charges. I offered over and over again to just repay her and have her understand what happened. She wanted none of it. A month later my sister talked her into dropping charges. However the police then filed Charges on me. I was at a loss of words. I don't understand how they can do that knowing it was a honest mistake. State troopers tend to be pricks around here. So in all this mess I was on probation when this occurred. They violated me and now want to send me to jail for two months for this probation violation, unless I get all charges dropped. The judge said I can't even have a summary offense or he's sending me to jail. Is there anyway I can fight this and have all charges dropped? I will agree to pay the card owner bak and whatever fines and costs I need to. But I can't afford these charges sending me to jail. This all occurred in Lebanon county pa. Please help!!!

    So basically, you thought you were stealing moms gift card, spent part of it, discovered it was not her card you stole, lied about it to family members, then after the police became involved, you were caught and fessed up. The relative initiating the charge, who you actually stole from, felt bad and dropped charges, but the police, tired of playing games with you picked up the charge and now you are buried so deep you want a quick fix, to make it all go away. I suggest you hire a lawyer fast. It appears you will be serving 2 sentences soon.

    How old are you? It sounds like you're far too old to be assuming that any cash or gift card mom leaves lying around is fair game.

    Your principal problem is that, to others, your story isn't very credible. You took a gift card. You were asked if you had seen a gift card and said "no". A full week later a police officer asked you about the same gift card and you still said "no" - then when told you were caught on tape admitted taking it but tried to call it a mistake. I don't think the officer or prosecutor (or sister, or person who sent the gift card, perhaps not even mommy) believe that things didn't "hit you" until that moment. On top of that, you've been in enough legal trouble that you're on probation and your probation officer wants to incarcerate you for two months over this incident.

    You claim that people "know" it was an "honest mistake" - how do they know that?
