    Default Extradition Proceedings Over a Probation Violation, New Crime

    My question involves criminal law for the state of: Texas and California
    My bf just got arrested for forgery of a financial institution in TX bc he tried to cash a check that he thought was his first paycheck for a job he took over the internet. His sheet says it's a state jail felony. He has not yet been to court for this so I am unsure how much time he is getting for this. He is also facing extradition to Cali and they have already issued a fugitive warrant for him since we waived his right to extradition and in-court appearance. His charge that he was on parole for was a misdemeanor petty theft charge but he has two strikes against him. My questions are: How much time could he be facing? Is eligible for half time or 85% time when he gets back to Cali? The TX jail is not telling him anything nor has a lawyer stopped by to see him.

    His maximum penalty will be the time remaining on his prior sentence, run consecutively with the time he receives on his new crime, with any application of habitual offender sentencing due to the fact that he has an extensive criminal record. He will need to review the details with his lawyer. You didn't share the code section for the exact crime charged; you can look up a Texas statute here.

    If you want a lawyer to stop by the jail to consult with him, you will need to hire a lawyer to do so. You stated that he has waived opposition to extradition, so he won't be getting a lawyer to assist with extradition proceedings. When he goes to court for his probation violation or new crime, he can inquire about a court-appointed lawyer if he qualifies.

    To answer all your questions there are going to have to be two attorneys. One for the Texas matter and one for the California matter.

    What if he has emails that state his instructions for an actual job? Maybe we were being naive about this but he checked the BBB website for scams that are outlined like the one he fell for and it didn't show up.
