    Unhappy Neither Landlord Nor Replacement Roommate Will Refund My Security Deposit

    My question involves landlord-tenant law in the State of: Pennsylvania

    In June of this year, I moved into an apartment (apartment 1) with my roommate. We both split the security deposit down the middle ($650 each), both signed the lease. A friend of my roommate needed a place to stay the next month so he stayed with us for a month. When it became apparent that he wanted to move in permanently, I decided I would move out. I called the landlord, explained the situation, and he had absolutely no problem in letting me break the lease and move out and the other guy replace me. By August 15th, I moved out and moved into a new place. Mind you, I still payed my portion of the rent for apartment 1 for August (split 3 ways this time). I moved in to my new place (apartment 2), paid my rent and security deposit there.

    After I moved out, the guy who replaced me was given a new copy of the lease and signed it. When I contacted the landlord at apartment 1 to ask for my security deposit, he told me I had to get it from the new tenant. When I contacted the new tenant, he told me I had to get it from the landlord. It is now November 21 (over 3 months later) and neither party will pay me my security deposit.

    The landlord keeps saying I need to get it from the new tenant, and the new tenant keeps saying that the landlord has my money, and I need to get it from him. Once he pays me, the tenant will pay the landlord. The landlord says he does not want to be involved, and that its my problem.

    Who owes me money legally? I thought that my security deposit is always mine? I am having financial issues right now and really need my money back but it is very frustrating situation. What do I do?

    No one owes you the money until the lease expires. Then the landlord will providing the new tenants kept everything ship shape. What you should have done, before you moved out, and before you agreed to let the new guy take your place, is to get the security deposit (his part) from him.
