    Default How Can I Get Emancipated to Live With a Friend

    My question involves juvenile law in the State of: Illinois

    I want to become emancipated when I am 16 and live with my friend Jean at her mom's house in Kewaskum, WI and i live in Johnsburg, IL. Living here with my parents hasn't been emotionally healthy for me and sometimes physically. The emotional distress causes physical distress to me. They emotionally abuse me and when I get emotionally distressed it causes me to starve myself and not want to eat or do anything.(physically unhealthy). I'm 14 at the moment and I turn 15 in January. I know what I have to do to get emancipated. I'll be getting a job pretty soon and earn money. I have lots of friends and family and school social workers and teachers and such to back me up as witnesses or proof to my emancipation that I am mature enough to be emancipated. My question is, am I allowed to move in with Jean if I get emancipated? If I talk to my parents about getting emancipated they will agree to it I just don't know how to start up the process and I'd like to find out first if I'm allowed to move in with Jean. I would be going to Kewaskum High and I'd pay for rent, food, clothing, etc. I can provide for myself quite easily I just need to know if I can be staying with them when I do get emancipated. And once I earn enough money I've been looking into this community college program up in West Bend, WI that is 15 minutes away from where Jean lives. So my education will be covered. I know I'm young and it's not just because I don't like my parents. Like I've been hospitalized because of my parents that's how bad they make me emotionally and mentally unstable at times.

    If you are not already 16 years of age, it's too early to think about emancipation.

    1) Does your state have statutory provisions for emancipation? If no, stop here. Emancipation is not an option for you.

    1b) If your state requires parental consent for emancipation, will your parents sign off? If no, stop here. Emancipation is not an option for you.

    2) If you answered yes to question one, how long have you been living apart from your parents? If the answer is less than 6 months, stop here. Emancipation is not an option for you.

    2b) How much money are you making at your full time job? If you are not employed, stop here. Emancipation is not an option for you.

    2c) In the time that you have been living apart from your parents, how much of your support do you provide? If the answer is less than 100%, stop here. Emancipation is not an option for you.

    3) If you have successfully answered all parts of questions 1 and 2, above, are you maintaining better than average marks in school? If you are not maintaining at least a B average in school, stop here. Emancipation is not an option for you.

    4) If you have successfully answered all of the above, what need do you have for emancipation? How will you convince the judge that emancipation is in your best interests? If your reason includes "boyfriend", "girlfriend", "mother is a bitch", "father is an asshole", or any complaint about "not allowed to do what I want", stop here. YOU ARE NOT A CANDIDATE FOR EMANCIPATION.

    If you are being abused, you call CPS.

    I'm actually involved in a case with DCFS and they've informed me that emancipation is an option?
    They're trained professionals in this field, and I'm not sure where you got that information. It's court discretion, the only requirement being maturity. My case is a lot like "ohmygod's", in that it revolves around abuse by parents.

    If emancipation is a law in your state, it is an "option". You just be a good lemming and do as they say.

    Let's start with this: You don't know what you are talking about.

    Let's continue: You've shared no facts, and have not identified your state. Some states have programs to transition children from foster care into independent living, and obviously those kids aren't eligible for emancipation in any classic sense. But there's not a state in the nation in which "It's court discretion, the only requirement being maturity".

    From actual statutes. You know, THE LAWS. They're different from state to state, in that in some states, you can't go to court to be emancipated at all, in a couple your parents have to file the petition, and in a couple more, emancipation only allows you to enter into contracts. In all cases where there is an emancipation process that allows you to live apart from your parents, you MUST be 100% self-supporting.

    It's court discretion, the only requirement being maturity.

    DCFS workers aren't attorneys, they are social workers. And social workers are among the WORST when it comes to giving IN-accurate information on emancipation. It might or might not be an option for you - we can't tell from here, because we don't have the details on your situation - BUT you are sorely mistaken if you think the only requirement is maturity. Have you READ the emancipation threads to understand the MANY things that the court will look for before considering emancipation?

    Which doesn't really impact the process of emancipation. The courts don't really care WHY you're seeking emancipation, they care if you meet the REQUIREMENTS of emancipation and can prove SELF SUPPORT to the courts satisfaction. Being a mature abuse survivor in and of itself is meaningless - what COUNTS are your grades, income, and criminal or mental health history, history of self support, and the ability to convince the court that you and you ALONE have shown a history of self support that promises to continue if emancipation is granted. Abuse, or not. And, only IF emancipation is even recognized in your state, and to what level.
