    Default Is It Legal to Receive a Parking Ticket in Your Own Driveway

    My question involves a traffic citation from the state of: Illinois.

    My vehicle was parked at the back of my driveway to the back and side of my house, and I received a parking ordinance violation on my windshield for Failure to display a valid vehicle tax sticker (this is a city sticker required from my village to own and operate a car on the city streets - I was late purchasing mine). My question is can they ticket my car in my own driveway? The circumstance of this is my driveway is long and the sticker is placed on the front windshield of my car which faces away from the street so an officer had to walk about 60 feet on to my property and walk around to the front of my vehicle to check if the sticker is up to date to write me a ticket. I already have to pay a fine for buying my sticker late which is fine and just, but I can't believe they also have the legal right to write me a parking ticket on my own property unless than can see the violation from the street which they couldn't possibly have done.

    Odd ... I cannot find a 13-126 in the Cook County, IL Ordinances. What CITY are you in?

    To answer the general question, yes they can write you tickets for such things in your driveway. Unless your car was completely enclosed by a fence, they're free to walk up your driveway, etc... to look at such violations.

    It depends on the violation, which is why I'd like to see the code section.

    In my state we couldn't cite for registration issues in the driveway.

    No, but laws regarding curtilage and the right of entry and access are somewhat universal. A violation that indicates it is a violation to operate a vehicle on a public roadway without such a permit would not necessarily permit the cite to be issued on a car parked in the driveway. Hence the reason we need to see the actual code section cited. And, to do that, we have to know the political subdivision in order to read the statute in question. It is possible that the cite was issued unlawfully.

    Agree - what the OP is calling a "parking ticket" likely isn't a parking ticket as one would normally think of them, but rather a notice of violation from code enforcement, as most jurisdictions address improperly registered vehicles on private property under similar "junked and abandoned vehicles" via that route. Can't speak for California, but here in Florida it works as Flyingron suggests - that unless the vehicle is ENCLOSED, either in something like a fenced back yard or within a garage, it's ripe to be picked for violation, even if the violation has to be seen from the driveway rather than the streetfront. The key will be the exact wording of the referenced local municipal code.

    Illinois, Cook County, Village of Evergreen Park. Sorry, I should have been more specific.

    The car and yard is enclosed on three sides by a fence but there is no gate or fence from the street side.
