    Default Pain and Suffering from an Auto Accident

    My question involves an injury that occurred in the state of: CA

    My daughter was injured in an accident where the other insurer is 100% at fault for texting and driving. She rear-ended us at a stop light. My daughter more injuries and has a herniated disk at C5-C6. She has has all treatment that she can and has basically has to just make sure she does physical therapy exercises at home to help her with her injuries.

    The adjuster has offer her $10,000 which is what her medical bills are and $5,000 for pain and suffering. I feel like due to the fact that she has a herniated disk for the rest of her life that the $5,000 is way too low.

    Can someone tell me what would be a reasonable offer for a injury such as this? I am just asking for a ballpark figure.

    We have no access to your daughter's medical records, and no information on the severity of the herniation or any resulting symptoms.. Tell her to take her medical records to a personal injury lawyer for review.

    strongly agree with Mr. K on the part about getting a lawyer.

    Pain and Suffering is meaningless, what really needs to be protected is coverage for future medical expenses if this is going to be an ongoing medical expense.
