My question involves labor and employment law for the state of: My husband works for a company that has on call. On call work is not clearly laid out in the handbook or in any policy or procedures. He works for a medical equipment supply company that delivers straight to people's homes and medical facilities. He works 8 hours Monday through Friday. Every 4 days he is required to be on call so that if there is a delivery after hours there he will be the one who is called to go deliver it. Currently we live in Lodi CA and he works in Sacramento ca. He is 33.7 miles from work. When he is on call he is allowed to bring home the company delivery truck in the event he is called out he go straight to the delivery point. He gets paid from the time he leaves our home to the time he returns back. Any delivery driver who is on call is allowed to bring their truck home. In one week we are moving to Jackson CA and will be 41.5 miles from his work. His boss is stating that he will no longer be able to bring the truck home when he is on call since he is moving to Jackson ca. He now will have to drive his car home and if he gets called out have to drive his car to work and pick up his truck and then head out to the delivery point. Then return the truck back to his work and return home in his person car. There is currently a delivery driver that lives 37.1 miles from work and is allowed to take the truck home. With no policy can they say everyone except my husband can take the truck home while on call? Also, one of the drivers is allowed to take the company truck home every day since he lives in Elk Grove CA which is fairly close to work.
