My question involves unemployment benefits for the state of: Florida

I had back surgery from a back injury years ago, that this job aggravated to the point the disc popped out. I did not go the route of workers comp, did not feel as it was needed at the time, you know what they say about hind sight. Well my employer and I agreed on me taking my vacation to do this surgery as the first surgeon(My surgery was done at my local Veterans Hospital) said it would take about a half hour for surgery, I would go home the same day, 2 weeks off, then back to work. Well, the V.A. changed surgeons on me, and between the first M.R.I. and the second, the disc was found to have popped out. While waiting for my surgery, I had to go to several tests, and one was for my heart as I have had a mild heart attack, and on the day of the test for my heart my boss texts me if they schedule my surgery before the 15th I F the company, yeah he is a bully boss and feels the V.A. is a charity case as well. So it takes about another 5 weeks until my surgery (Sept 10,2012) and when I am at the hospital waiting in bed for my turn, the new surgeon explained to me that my disc is out and will be removed and I am now looking at 6 weeks off and possibly not being able to do my line of work which is Pest control and Termite work. After 3 weeks and no improvements, he and his partner and the V.A. wrote a note for Job Retraining which I could go through the V.A. ( the very long wait way) or through Vocational Rehab at my local one stop career center run by the state which I am enrolled in. I gave my employer the letter and said my goodbyes. After my 6 weeks and I got my release, I decided to file for my Unemployment Benefits, Ironically my ex boss called me and said for me not to file for U.I. that things were slow, and he would deny the benefits claiming he had "suitable" work for me to do. I explained to him that I was going to file and he does not have a good track record of being disabled friendly as I am a Diabetic and have copies of all my work schedules showing no breaks in 12 to 14 hour days, I also have the letter where we were to volunteer one of our days off a week for the next 4 months or lose days so he can hire another employee. I have a doctors note explaining to retrain and not return to the physical demands of that job, I have to be tested and the state is to find what is suitable within my limitations.
Now if he denies my benefits, do I at least have grounds to stand on for an appeal? What should be said. He was a bully boss, but I could handle that, I do miss the employees there,my doctor suggested SSI Disability as well, as now where they removed the disc, it is now narrowing and compressing on my nerves again, and I am in pain again and will possibly go under the knife again. I have a lawyer for the disability in which he is confident I will get it, and he is working on my V.A. rating, which seems like it will go through as well.
