This has to do with the state of California and actually doesn't pertain to myself so I only have limited information to go on.
A) If the FBI needs to acquire an individual's fingerprints, to compare them against fingerprints found at a crime scene, does the individual need to be arrested? Can they be detained? This individual is a suspect, and has been in for questioning, but he/she has not been arrested nor does he/she have a prior arrest record.
B) Once the FBI has the prints for analyses, will they also use the prints to check for priors? (IE will they run the prints through their NCIC...Would this be done before or after). Would the FBI still do this if the prints came up clean and the suspect is cleared of any wrong doing? The suspect, by the way, already had a background check (and cleared) through the FBI, but not via fingerprinting.
