    Default Theft from in Employer

    My question involves criminal law for the state of: Texas

    I greatly appreciate any advice.

    Today, I went to work and was brought into the managers office and talked to Loss Prevention at my work. I stole around $300 from the retail store I work at. I took little amounts of money over the span of a couple of days. This is the first time committing a crime and have never been in trouble with the law besides speeding tickets. I am currently on suspension with my employer and I am charged with Criminal Trespassing. Also, I was told by the officer a detective would get in contact with me with the investigation.

    Why question is, what should I expect from the courts? Will I be arrested? What will happen?

    I can not go to jail due to school and moving into my new place.
    Please any advice?

    The time to think about that was before you stole.

    It is no longer within your control whether you go to jail or not.

    My answer is still the same as the other post:

    You likely already know you have lost your job and don't even bother to file for Unemployment.

    Background check - if a thorough check is done, it can show you have been arrested for (whatever the police officer put down as a charge). Since police were involved, yes, you have been technically arrested, even if there were no handcuffs, etc.

    You do need a criminal defense lawyer. Ask about Diversion Programs.

    You can expect: Court costs and fines; Restitution to the store (expect 2-5 times the amount you are accused of taking); and possibly probation. Probation, as well as a Diversion Program or Community Service will cost you additional money (if you get Community Service - expect to pay $10 per hour for the privilege).

    Job wise....even if you get hired at your interview....if they do a background check later, you can still be terminated. So be honest if you are asked about any criminal charges. Do not expect to working around money or credit cards....Do not count on a good reference from the store you stole from. And you may also be entered into the National Retail Theft Database for seven years.
