My question involves criminal law for the state of: All states?

If undocumented aliens are not seen as persons - have no personal rights - under the law [as explained by Noam Chomsky, Commonwealth Club, CA, 2009], is hurting or killing an undocumented alien not assault or murder in the eyes of US law?

The aim is to clarify : Under what juristictions are "undocumented aliens" equalling "not persons"?
    - Just regarding denying them healthcare, or is the definition judicially universal?

    We're doing homework, aren't we?

Chomsky? Not sure of your claim of the source. The basis of the statement is much older than Chomsky.

I think Chomsky was the guy that had a problem with the inability see multiple perspectives due to the lack of ability to remove oneself from their limitations of perception of a subject. Something like this:

Do you see the duck or the dog?

and who didn't realize that mallards wore dog masks?

Beyond that, both issues deal with perception which is exactly what the OP is asking about here. Does one have different rights as a human simply based on how we perceive them? The answer is addressed in both of the situations I brought up. They both allow for a yes and no answer, depending on one's own perception of the event. Obviously neither alters the answer to the question asked since one's perception does not alter the legal reality of the situation.
