    Default Working Under a False Name and SSN

    I may be looking in the wrong spot but im trying to find out some info on the possible charges that can be brought against someone for working under a false name.

    the situation is as follows.....

    A person working for a restaurant under their legal name ans ssn who worked something out with the GM to work under a friends name and ssn to get more hours due to hard times. it only went on for maybe a month or two not exactly sure but the two id's were never clocked in at the same time. so they were actually working all the hours not getting paid double for one shift. Well the GM ended up quitting a few months later cause of a heart attack and open heart surgery. There were not many people that knew about the arrangement. but six months after the fact the regional manager showed up and terminated the employee and was gave them a letter that it was reported to the DA. They dont exactly have any proof that it was them and gave them a phone number and email to dispute the termination.

    My question is exactly how much trouble can someone get into with this situation? Would it be easier on them to confess to it? Also the person is on a 1 year probation for a bogus check. And will it make a difference that the working under the false name took place before the probation was set for the check that was written 2 years earlier.

    Ill explain the last line a little more the check was written a few years back they were working at this restaurant for about 6 months before the started using the other name then they got arrested during a traffic stop for the warrant for the check got probation and went back to work but stopped using the other name before the arrest. will it still go against the probation if charges are brought up as a probation violation even though it happened before the probation started?

    What did your attorney say when you asked him/her these questions? (And if you haven't got an attorney, you need one, quick.)

    I don't know why someone would have to work under another person's identity to get more hours.

    I don't see a prosecutor caring much about this to expend taxpayer resources on it.

    I wouldn't let my mind run amuck unless and until someone is advised by law enforcement or prosecutor that they are being charged. It's best not to ask strangers what "will" happen, because they cannot know.

    To get more hours without the employer having to pay time and a half for overtime.

    I am not sure that the employee committed a crime as much as the employer did...but there are some definite tax complications.

    I wouldn't let my mind run amuck unless and until someone is advised by law enforcement or prosecutor that they are being charged. It's best not to ask strangers what "will" happen, because they cannot know.

    So you think it's okay to use someone else's SSN? That tells me about all I need to know about you...

    No, I do not think its ok. However, if the other party (the one whose SSN was used) was aware of what was going on then it wasn't identity theft...or if it was a made up name and SSN it wasn't identity theft either.

    And who says that the other person was aware of it? The OP didn't.

    As a matter of fact, it would still be identity theft, except that there'd be three people complicit instead of only two.
